Insurers Appeal Pleural Plaques Ruling

As previously reported by Personal Injury Scotland a judicial review of the Damages (Asbestos Related Conditions) (Scotland) Act 2009 by four major insurance companies was unsuccessful.

However, Aviva, Axa Group, RSA Insurance Group and Zurich Financial Services Group have now lodged an appeal against the judgment, claiming that the Act ignores medical evidence that pleural plaques are symptomless and that compensation is only payable where harm has been caused.

The appeal means that ongoing pleural plaques cases will remain on hold until the appeal has been determined.
