Tracing Employers Liability Insurance Policies
A new report from the Department for Work and Pensions continues to highlight the need for a workers compensation fund which would operate in a similar way to the Motor Insurers Bureau.
The Association of British Insurers has been operating a voluntary scheme for tracing former employers' liability insurance policies since 1 November 1999 but the new figures released show that of 13098 enquiries, only 5878 (45%) were successful in tracing insurance details.
Ultimately, this means that 55% of enquiries are unsuccessful and therefore many injured and dying workers are potentially missing out on compensation because insurers for the relevant period cannot be identified.
An Employers Liability Insurance Bureau Bill was introduced as a private members bill and received its First Reading on 6 January 2010.It was due for a Second Reading on 5 February 2010 but the debate was adjourned and will resume on 26 February 2010.
The report from the Department for Work and Pensions clearly shows a need for a workers compensation fund as the current voluntary scheme is failing.Jack Straw, Secretary of State for Justice, indicated earlier this year that he would look into the support given to individuals who are unable to trace employers' insurance records. These figures highlight the need for urgent action to be taken.
