FAQs

How long will my claim take?
This will depend on the circumstances of your claim. Although our team of solicitors are focused on ensuring your claim progresses as quickly as possible there is an agreed protocol between solicitors and insurance companies operating in Scotland. The insurance company (or representative acting on behalf of the insurance company) should confirm if your claim is accepted within 3 months.

If your claim is accepted your solicitor will strive to do everything they can to provide you with as quick and beneficial an outcome as is possible.

How much is my claim worth?
The scale of compensation is very wide, but ultimately any financial award made depends on the severity of your injury and it's consequences for you.

You can claim for the injury, pain and suffering known as solatium, you can also claim for loss of income and out of pocket costs. You may also claim for any necessary services, such as help with activities of daily living, rendered by a relative, and for any personal services which you have been unable to render to a relative. In more serious cases there may be continuing or future losses to consider.

What if my injury occurred a while ago?
You generally have 3 years from the accident date to make a claim. If you were under the age of 16 at the accident date, the 3 years does not start to run until your 16th birthday.

Some exceptions apply, for example personal injury claims arising from air/sea accidents and criminal injury compensation claims are subject to a 2 year time limit.

What Does No Win No Fee mean?
No Win No Fee means exactly that. If we do not take your claim on or your claim is unsuccessful you will not pay us a penny.

How much will it cost if I win my claim?
If you win your claim, you pay us a variable success fee which will never exceed 25% (excluding VAT) of the compensation which you are awarded.

Regardless of the No Win No Fee arrangement, we will devote as much time to you and your claim as is required and the success fee is in exchange for the risks we take of being paid nothing if your claim is unsuccessful.

 

Your solicitors fees and outlays are generally covered by your opponent.

 

I don't live in Scotland - can I still make a claim?
So long as your accident occurred in Scotland, it does not matter where you live. We can help you, just contact one of our solicitors.
